Bailiffs

Authority


Bailiffs have state-wide jurisdiction to enforce the judge's orders. They may make arrests on bench warrants (such as failure to pay court fines). They also are allowed to receive jury verdicts and administer oaths (such as swearing in witnesses).

Duties & Responsibilities


There are criminal and civil court bailiffs. Civil bailiffs serve:
  • Asset seizures (such as business cash register attachments and automobile replevins)
  • Civil lawsuits
  • Eviction orders
  • Garnishments of wages and bank account attachment
Training
Bailiffs are required to have State and local training in:
  • Arrest procedures
  • Firearms training
  • Legal matters
  • Process serving
  • Security training
In Middletown, there are currently three bailiffs assigned to four areas: criminal court procedures, civil court procedures, court security, and warrant bureau duties.
